DRAFT: pending Compliance review. Not final legal text. Do not rely on it.
1. Who we are
Lumi Labz is the trading name of [PLACEHOLDER - needs Christopher: trading name/legal identity]. Address: [PLACEHOLDER - needs Christopher: geographic service address (registered-office or virtual-office service, never a home address, not a PO box)]. Email: [PLACEHOLDER - needs Christopher: brand email, e.g. hello@lumilabz.co.uk, not yet set up].
2. Who sells to you
Lemon Squeezy (Sold through Link, LLC, 222 South Main St, Suite 500, Salt Lake City, UT 84101) is the seller (merchant of record) of your purchase; Lumi Labz supplies and licenses the content. Lemon Squeezy takes payment and collects and pays VAT and other sales taxes. Lemon Squeezy's buyer terms govern payment, tax and the processing of refunds. Your licence to use the content, and our promises about its quality under the Consumer Rights Act 2015, come from Lumi Labz under these terms.
3. Products
We sell digital downloads (PDF worksheet packs and printables). Each product page shows the price including any VAT, the format, compatibility and licence before you buy. Books are sold on Amazon under Amazon's terms. App purchases are made through Google Play under Google's terms.
4. Prices and payment
Prices are in pounds sterling and include any VAT. The checkout shows the final total before you pay. The price shown on our product page is the total you pay at checkout in the UK; there are no extra fees. Lemon Squeezy, as seller, accounts for VAT.
5. How to order and when the contract is made
- On the product page, read the key information and tick the box confirming your consent to immediate access (section 7).
- Continue to the Lemon Squeezy checkout, enter your details and check your order summary. You can correct any mistakes in your details at checkout, or go back to the product page, before you submit.
- Submit and pay.
The contract is made when Lemon Squeezy accepts your order and sends your order confirmation email. Your confirmation email includes the key details of your order and repeats your consent to immediate access. The contract is in English.
6. Delivery
Download links are shown after payment and emailed to you. If a link does not work, contact us and we will send a new one.
7. Cancellation of digital content
You normally have 14 days to cancel a distance purchase. For digital downloads you lose this right once the download is made available, but only if you gave your express consent to immediate supply and acknowledged that you would lose the right. Before checkout you will be asked to confirm this, and your order confirmation email repeats it. Full details: Refunds and cancellation.
8. Faulty content: your statutory rights
Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair or replacement, or if that is not possible, a price reduction or refund. If digital content we supply damages your device or other digital content and this happened because we did not use reasonable care and skill, we will repair the damage or pay you compensation (Consumer Rights Act 2015, section 46). Nothing in these terms affects your statutory rights.
9. Licence
You buy a licence to use the files, not the copyright. Each product shows its licence: Personal use (your household) or Personal and classroom (your household, or one teacher or parent and up to [N - PLACEHOLDER, Christopher to set, e.g. 30] children taught together in one class or home-education group). Schools needing more copies: contact us. You may not resell, share, upload or redistribute the files.
10. Liability
We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We do not exclude liability where it would be unlawful to do so.
11. Complaints and law
Please contact us first: [PLACEHOLDER - needs Christopher: brand email, e.g. hello@lumilabz.co.uk, not yet set up]. These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may bring proceedings there.
